The Deceptive Trade Practices Act is a Texas state law modeled after the Federal Trade Commission Act which was instituted to help protect consumers in the 1960’s. The federal law, as amended, focuses primarily on unfair competition, deception of consumers, helping facilitate compensation for practices that hurt consumers, and researching and influencing policy decisions at the federal level. Because the federal law only applies to businesses involved in interstate commerce, individual states all enacted similar laws to protect consumers at the local level. Over the years the law has been determined to protect consumers from a wide variety of predatory and deceptive practices.
