How long do I have to file a claim?

What if I was partly at fault?
Under Texas law, if you are found more than 50 percent at fault, you cannot recover. If your share is 50 percent or less, you can still recover, but your recovery is reduced by your percentage of fault.

You do not have to give a recorded statement to the other side's insurer. Their job is to pay as little as possible. Talk with a lawyer first.
What if the driver who hit me has no insurance or not enough?
Your own auto policy may help. Uninsured and underinsured motorist coverage can pay when the at-fault driver has little or no insurance, and in Texas that coverage is part of your policy unless it was rejected in writing. We can review your policy with you.
